Section 7:50-9.11 - Purchase and conditions(a) To the extent that funding permits, the Department of Environmental Protection shall pursue the acquisition of eligible parcels in the order established in N.J.A.C. 7:50-9.8.(b) The Department of Environmental Protection may decline to acquire any parcel at any time prior to the transfer of title for the following reasons: 1. The parcel does not meet the standards set forth in N.J.A.C. 7:50-9.2 and 9.3;2. Failure of the owner of the parcel to respond to a purchase offer within a reasonable time period or to accept the offer made by the Department of Environmental Protection; or3. Conditions exist either on the parcel or on contiguous lands which either would require remediation in order to alleviate a hazard to the public or would otherwise incur additional costs to resolve.
