Section 7:50-6.85 - Individual and non-individual onsite subsurface sewage disposal systems and petroleum tank maintenance(a) The owner of every traditional individual and non-individual onsite subsurface sewage disposal system in the Pinelands shall as soon as suitable septage disposal facility capacity is available, in accordance with the provisions of Chapter 326 of the Solid Waste Management Act, 13:1E-1 et seq., and Section 201 of the Clean Water Act: 1. Have the system inspected by a technician at least once every three years;2. Have the system cleaned at least once every three years; and3. Once every three years submit to the board of health serving the municipality in which the system is located a sworn statement that the system has been inspected, cleaned and is functional, setting forth the name of the person who performed the inspection and cleaning and the date of such inspection.(b) All Pinelands alternate design wastewater treatment systems in active use shall be equipped with a functioning alarm system that conforms to the requirements at N.J.A.C. 7:50-6.84(a)5iv(2)(G) and shall be covered under a renewable operation and maintenance contract that conforms to the requirements at N.J.A.C. 7:50-6.84(a)5iv(2)(K), for as long as the system is in active use.(c) Every owner or operator of a Pinelands alternate design wastewater treatment system in the Pinelands Area shall comply with the maintenance and monitoring requirements of N.J.A.C. 7:9A-8.3 and 12.3.(d) The owners of commercial petroleum storage tanks shall comply with the requirements of P.L. 1986, c. 102 (58:10A-29) .N.J.
