Section 7:30-11.11 - Criminal action(a) The Department, upon petition to the Attorney General, may bring a criminal action in court for certain violations of the Act, or any rule promulgated, and any administrative order, permit, license, certification, or other operating authority issued pursuant to the Act.(b) A person who purposely, knowingly, or recklessly violates the Act, or including any rule promulgated, and any administrative order, permit, license, certification, or other operating authority issued pursuant to the Act, shall be guilty, upon conviction, of a crime of the third degree and shall be subject to a fine of no less than $ 5,000, nor more than $ 50,000 per day of violation.(c) A person shall, upon conviction, be subject to a fine of no more than $ 50,000 if the person purposely, knowingly, or recklessly: 1. Makes a false statement, representation, or certification in any application, record, or other document filed or required to be maintained under the Act, or any rule promulgated, and any administrative order, permit, license, certification, or other operating authority issued pursuant to the Act; or2. Falsifies, tampers with, or renders inaccurate, any record or monitoring device to be maintained under the Act, or any rule promulgated, and any administrative order, permit, license, certification, or other operating authority issued pursuant to the Act.N.J.
