Section 7:27-12.2 - Emergency criteria(a) A condition justifying proclamation by the Governor of an air pollution alert, air pollution warning, or air pollution emergency shall be deemed to exist whenever the Commissioner determines that the accumulation of air contaminants in any place, locality, county or other area in the State is attaining or has attained levels which could, if such levels are sustained or exceeded, lead to a threat to the health of the public.(b) Such determinations shall be in accordance with criteria published in the New Jersey Register and on file with the Department.N.J. Admin. Code § 7:27-12.2
