Section 7:14A-11.3 - Additional requirements for all existing manufacturing, commercial, mining, silviculture, and research facilities
(a) The following condition, in addition to those set forth in 7:14A-11.2 and the general conditions applicable to all permits in 7:14A-6.2, applies to all DSW permits for the facilities specified below:
1. In addition to the reporting requirements under 7:14A-6.5 and 6.10, all existing manufacturing, commercial, mining, and silvicultural dischargers and research facilities shall notify the Department, in writing, as soon as they know or have reason to believe:
i. That any activity has occurred or will occur which would result in the discharge of any toxic pollutant which is not limited in the permit if such discharge will exceed the highest of the following notification levels:
(1) One hundred micrograms per liter (100 [LESS THAN] micro g/L);
(2) Two hundred micrograms per liter (200 [LESS THAN] micro g/L) for acrolein and acrylonitrile; five hundred micrograms per liter (500 [LESS THAN] micro g/L) for 2,4-dinitrophenol and for 2-methyl-4,6-dinitrophenol; and one milligram per liter (1 mg/L) for antimony;
(3) Five times the maximum concentration value reported for the pollutant in the permit application in accordance with 7:14A-4.4(b); or
(4) The notification level established by the Department in accordance with 7:14A-6.2(b)2.
ii. With the exception of research facilities, that they have begun or expect to begin to use and manufacture as an intermediate or final product or by-product any toxic pollutant which was not reported in the permit application pursuant to 7:14A-4.3(a)19 or in the request for authorization under 7:14A-6.13(d), unless the general permit expressly refers to a "request for authorization" and does not require the request for authorization to include a listing of toxic pollutants.
