Section 7:12-9.9 - Permit for the Harvest of Seed Oysters and/or Seed Clams from Restricted Waters and Transplant to Approved Waters
(a) The Permit for the Harvest of Seed Oysters and/or Seed Clams from Restricted Waters and Transplant to Approved Waters authorizes the harvest of seed oysters and/or seed clams from waters classified as Restricted for transplant to a lease(s) in waters classified as Approved for grow-out and reduction of pathogens prior to direct marketing.
(b) In addition to the completed Consolidated Permit Application form and the application fee required under 7:12-9.3, an applicant for a Permit for the Harvest of Seed Oysters and/or Seed Clams from Restricted Waters and Transplant to Approved Waters shall submit:
1. A copy of a valid shellfish license; and
2. A map showing the general area from which seed are to be harvested and the boundaries and GPS coordinates of the lease to which the seed will be transplanted.
(c) The Permit for the Harvest of Seed Oysters and/or Seed Clams from Restricted Waters and Transplant to Approved Waters is subject to the following specific requirements and conditions:
1. The only shellfish seed that may be harvested and transplanted under this permit are oysters (Crassostrea virginica) and/or hard clams (Mercenaria mercenaria).
2. The permittee shall telephone the Department's Division of Fish and Wildlife, Bureau of Law Enforcement, Marine Region, at 609-748-2050 at least 24 hours prior to harvest of seed and provide the following information: the permit number, the identity of person calling, a description of vessel(s) being utilized, the location of harvest, and a contact number for the person calling.
3. The permittee shall have the issued permit document in possession while conducting activities authorized under this permit.
4. No more than three percent of the number of shellfish harvested and transplanted shall be larger than seed.
