Section 6A:16-3.2 - Confidentiality of student alcohol and other drug information
(a) Each district board of education shall assure compliance with the following confidentiality requirements consistent with the implementation of 20 U.S.C. § 1232g, the Family Educational Rights and Privacy Act, and 34 CFR Part 99 :
1. Confidentiality of substance use disorder patient records, pursuant to 42 CFR Part 2 ; and
2. Confidentiality of information provided by an elementary or secondary school student while participating in a school-based drug and alcohol counseling program that indicates the student's parent or other person residing in the student's household is dependent upon or illegally using substances pursuant to N.J.S.A. 18A:40A-7.1 and 7.2.
