Section 5:44-3.2 - Board composition
(a) The board of each local housing authority shall consist of seven members, one appointed by the mayor or chief executive officer of a municipality, five by the governing body, and one member appointed by the Commissioner of the Department, in accordance with the guidelines prescribed in 40A:12A-17.
1. Members shall serve for terms of five years and until their successors have been appointed and qualified (that is, sworn). However, members who are not in compliance with the training requirements shall not continue to serve as holdovers when their terms expire or they are deemed resigned.
2. State-appointed members may be removed from office only by the appointing agency. An aggrieved authority may petition the Department for removal of a State appointee for "inefficiency or neglect of duty." The appointee is entitled to a fair hearing.
(b) The board of a redevelopment agency shall consist of seven members, appointed by the governing body, as prescribed in 40A:12A-11.
(c) No more than one member of a housing authority and no more than two members of a redevelopment agency shall be an officer or employee of the municipality or county by which the authority or agency is created.
