Section 17:30A-13.4 - Quality control; sample collection; chain of custody
(a) To ensure the safety of registered qualifying patients, an ATC shall provide samples to the Commission during announced and unannounced inspections for product quality control.
(b) To implement the requirement in (a) above, the Commission shall:
1. Collect soil and plant samples and samples of products containing marijuana cultivated and/or dispensed, as applicable, by the ATC;
2. Place the permit number of the ATC on each sample container;
3. Label the sample containers with a description and the quantity of its content;
4. Seal the sample containers; and
5. Have ATC and Commission staff initial each sample container.
(c) The Commission shall maintain documentation of the chain of custody of samples taken.
1. The Commission shall provide a receipt for the collected samples to the ATC's authorized representative.
2. The Commission shall maintain an accounting of all collected sample containers for control purposes.
3. The Commission shall test samples.
i. Sample testing may include tests for, among other things, the presence of pests, mold, mildew, heavy metals, and pesticides and the accuracy of labeling.
4. The Commission shall issue written reports of the results of its testing to the ATC.
5. The ATC shall pay the expenses for the testing.
