Section 17:10-3.4 - Survivor benefits(a) Payment of benefits to eligible survivors shall become effective on the first of the month subsequent to the member's death and shall terminate on the first of the month subsequent to the date on which the survivor no longer qualifies for such benefits.(b) In the instance of survivors of members who die in service, the initial pension payment will be for the month following the month in which the member died, and the last payment will cover the month the survivor dies or ceases to qualify for the continuance of benefits. In the event that the member has no surviving spouse, civil union partner, domestic partner, child, or parent who is eligible for the survivor benefit; and no other beneficiary designation is in effect at the time of the member's death, the Division shall pay the deceased member's aggregate contributions to the deceased member's estate.(c) If a member dies in "active" status, a return of contributions plus interest up until the date of death will be paid to the designated beneficiary on file or, if no beneficiary was selected, to the deceased member's estate.N.J.
