Section 13:40-9.1 - Professional engineers: supervision of subordinates; maintaining records of adequate supervision; acts reflecting inadequate supervision(a) A licensee in responsible charge of an engineering project shall be a competent professional engineer who provides regular and effective supervision through personal direction to, and quality control over, the efforts of subordinates of the licensee that directly and materially affect the quality and competence of engineering work rendered by the licensee.(b) A licensee shall maintain such records as are reasonably necessary to establish that the licensee provided regular and effective supervision by personally directing, and having quality control over, the efforts of subordinates of the licensee of which he or she was in responsible charge.(c) A licensee engaged in any of the following acts or practices shall be deemed not to have rendered the regular and effective supervision required if: 1. The failure to personally inspect or review the work of subordinates where necessary and appropriate;2. The rendering of a limited, cursory, or perfunctory review of plans or projects in lieu of providing sufficient direction to, and quality control over, the efforts of subordinates of the licensee; and3. The failure to personally be available on a reasonable basis or with adequate advance notice for consultation and inspection where circumstances require personal availability.N.J. Admin.
