Section 13:35-14.17 - Confidentiality(a) Licensed genetic counselors shall maintain the confidentiality of client records and any confidential information acquired from a client, except that: 1. The licensed genetic counselor shall release client records as directed by a subpoena issued by the Board or Committee, or the Office of the Attorney General, or by a demand for a statement in writing under oath, pursuant to 45:1-18. Such records shall be originals, unless otherwise specified, and shall be unedited, with full client names;2. The licensed genetic counselor shall release information as required by Federal or State statutes or regulations;3. The licensed genetic counselor may disclose confidential information if he or she is party to a civil, criminal, or disciplinary action arising from the genetic counseling services provided; or4. The client is a defendant in a criminal proceeding and keeping client records or information confidential would violate the defendant's right to present testimony and witnesses on his or her behalf.
