Contested case hearings to determine whether seized property constitutes unlawful property and shall be forfeited, shall be conducted according to N.J.A.C. 1:1 and either retained by the Director, Division of Alcoholic Beverage Control under the provisions of 52:14F-8 or filed with the Office of Administrative Law pursuant to 1:1-5.1.
