Section 12:120-4.7 - License performance standards(a) Every licensee shall ensure that all asbestos work performed conforms to those license performance standards as identified at N.J.A.C. 12:120-4.4(a)3 and 8:60-4.4(a)3, including, but not limited to, the following:1. Accepted engineering practices which protect human health and the environment;2. Compliance with 40 C.F.R. Part 61, National Emission Standards for Hazardous Air Pollutants, Subparts A and M;3. Compliance with N.J.A.C. 7:26, Solid and Hazardous Waste Regulations; and4. Compliance with N.J.A.C. 5:23-8, Asbestos Hazard Abatement Subcode of the Uniform Construction Code in educational facilities and public buildings as defined at 5:23-8.2.(b) Every licensee who performs asbestos work shall ensure that a permitted supervisor is on-site throughout the course of the project.1. The permitted supervisor and licensee shall be responsible for ensuring that the asbestos work is performed in accordance with the provisions of this section through periodic visual inspections and immediate correction of problems.(c) Every licensee shall provide for a final inspection upon completion of the project. 1. This final inspection shall include a thorough visual inspection of the work site and clearance air monitoring. A sufficient number of air samples shall be taken to be representative of the work area. i. For abatement actions less than or equal to 160 square feet, or less than or equal to 260 linear feet, clearance air samples may be analyzed by PCM. The clearance air samples shall be considered acceptable when each of the samples analyzed indicates a fiber concentration of less than or equal to 0.01 f/cc of air.ii. For abatement actions greater than or equal to 160 square feet, or greater than or equal to 260 linear feet, clearance air sampling shall be conducted by TEM in accordance with 40 C.F.R. 763.90(i)(3) and (4).(d) Every licensee shall be responsible for immediately having corrected at no additional charge to the customer, any violation of the standards of (a) above discovered in the work performed by the licensee.N.J.
