Section Tra 201.02 - Scope(a) This chapter shall provide rules of practice and procedure for:(1) The conduct of adjudicative hearings in contested cases;(2) The conduct of nonadjudicative hearings for:b. Administration of programs within the department's jurisdiction;(3) The issuance of declaratory rulings; and(4) Determining whether to grant or deny petitions for rulemaking.(b) The model rules specified in RSA 541-A:30-a shall apply to adjudicative hearings conducted by the department only to the extent that these rules do not address a practice or procedure addressed in the model rules. A rule adopted by this chapter that addresses a specific procedure shall control that procedure, and the model rule shall not apply even if the rule adopted in this chapter conflicts with, is narrower than, or is broader than the model rules.N.H.
