Section Site 202.19 - Burden and Standard of Proof(a) The party asserting a proposition shall bear the burden of proving the proposition by a preponderance of the evidence.(b) An applicant for a certificate of site and facility shall bear the burden of proving facts sufficient for the committee or subcommittee, as applicable, to make the findings required by RSA 162-H:16.(c) In a hearing held to determine whether a certificate, license, permit or other approval that has already been issued should be suspended, revoked or not renewed, the committee or subcommittee, as applicable, shall make its decision based on a preponderance of the evidence in the record.N.H.
