Section Res 5502.01 - Control Areas(a) When the director following consultation pursuant to RSA 227-K:3, II, determines that a non-native pest exists on any lands within the state, whose spread to adjacent lands threatens the forest health, the director shall designate the affected area as a control area. Following designation of a control area, the landowner shall be notified pursuant to Res 5502.02.(b) Landowners of designated control areas shall comply with any control measures ordered by the director which are practical and employ proven technology and will eradicate the insects or disease. Such orders shall include, but not be limited to, the removal and destruction of all plants infected by disease or insect infestations.(c) The director shall, if the landowner does not comply with (b) above, remove and destroy all plants infected by disease or insect infestations.N.H.
