Section Pda 502.23 - Shorefront property(a) Means: (1) Any property recognized as a legal building lot by a municipality with shore frontage on state tidal waters;(2) A lot on state tidal waters that is divided by a road so that the buildable portion of the lot is on the opposite side of the road from the state tidal waters or divided by an exclusive right-of-way which has been acquired as a result of an eminent domain proceeding which resulted in the break or loss of property between the property owner's residence and the portion of the lot with shore frontage; or(3) A lot of record with shore frontage on state tidal waters; and(b) Does not include: (1) A deeded right-of-way;(2) A right-of-way or right of access granted by lease or any other type of agreement; or(3) Lots not contiguous to the shore.N.H.
