These rules set forth requirements pursuant to RSA 326-B:9 and RSA 326-B:32 requiring nursing assistant training and competency testing. The Omnibus Budget Reconciliation Act (OBRA) of 1987; Section 1819 and 1919 of the Social Security Act ( 42 U.S.C. 1395 & 1396) and RSA 326-B authorize a registry that lists all nursing assistants who qualify through education and testing to provide nursing-related activities.
