Section Mtec 204.02 - Informal Resolution
(a) Pursuant to RSA 328-I:10, XIII, the board shall dismiss a complaint when the undisputed allegations do not warrant disciplinary action against a registrant because:
(1) The board lacks jurisdiction over the subject matter of the complaint; or
(2) The facts, taken in a light most favorable to the complainant, do not allege a violation of RSA 328-I;
(3) The facts do not relate to actions of the registrant; or
(4) Any action based upon the alleged facts is time barred by RSA 328-I:10, XII.
(b) Pursuant to RSA 328-I:10, II, the board shall initiate non-disciplinary remedial proceedings when:
(1) It receives a written complaint from any person that a registrant is afflicted with any of the following conditions that if untreated or uncontrolled could constitute a danger to the public health:
a. A physical or mental disability or disorder; or
b. A communicable disease; or
(2) It receives information about one or more practices engaged in by a registrant which, if continued, would result in disciplinary action against the registrant.
