Section Man 211.02 - Standard for Granting Motion for Rehearing(a) A motion for rehearing in a case subject to appeal under RSA 205-A:28, II shall be granted if it demonstrates that the board's decision is unlawful, unjust or unreasonable.(b) A motion for rehearing in a case subject to appeal to the superior court shall be granted if it demonstrates that the board's decision is illegal in respect to jurisdiction, authority or observance of law, an abuse of discretion or arbitrary, unreasonable or capricious.N.H.
