Section Lot 220.01 - Rulemaking Petitions(a) Any interested person may petition the commission for the adoption, amendment, or repeal of any commission rule under RSA 541-A.(b) Within 30 days of the receipt of the completed petition required by Lot 220.03 below, the commission shall either:(1) Initiate rulemaking procedures in compliance with the petition and in accordance with RSA 541-A; or(2) Deny the petition in writing, stating the reasons for the denial. Such reasons shall detail why the commission has concluded that the problem can be solved by a method that does not require a formal rulemaking proceeding.(c) The commission shall determine whether to initiate a requested procedure or deny a petition based on whether the requested change is consistent with the duties of the commission under RSA 284:12, and RSA 284:21-i and whether the issue can be addressed without rulemaking.N.H.
