Section Lab 804.05 - Renewal Application(a) If the employee and the employer wish to continue the employment relationship at a sub-minimum rate, the applicant shall reapply prior to the expiration date of the permit.(b) The applicant for a renewal of the permit shall indicate on the application that the application is for a renewal of the permit.(c) If the employees earning capacity has increased, but not up to minimum wage, the new sub-minimum wage rate shall be indicated on the renewal application.(d) The renewal application shall be evaluated by using the same criteria as outlined in Lab 804.03.(e) Upon acceptance of the renewal application the department shall issue a permit pursuant to Lab 804.04.N.H.
