(a) A carrier offering health coverage in the individual market: (1) Shall make all of its individual health plans available for purchase;(2) Shall not make available or offer any coverage that has been discontinued in accordance with RSA 420-G:5, VI. or VII.; and(3) May limit health coverage offered to individuals based only on health status.(b) Carriers shall vary rates for health coverage in the individual market by using only the following allowable case characteristics: (1) The attained ages of the covered individual and any covered dependents;(2) The tier category, or the number of covered individuals;(3) The smoking status of the covered individuals; and(4) The health status of the covered individuals.(c) Rating factors based on attained age, smoking status and health status shall be guaranteed for a 12 month rating period.N.H.
