Section He-W 549.09 - Third Party Liability(a) All third party obligations shall be exhausted before Title XIX shall be billed, in accordance with 42 CFR 433.139, with the exception of the following: (1) Pregnant women and children who are covered by third party liability, enforced by the New Hampshire division of child support services, shall be exempt from third party billing practices; and(2) All preventive pediatric and prenatal care services shall be exempt from third party billing practices.(b) Participating providers may bill medicaid directly for (a)(1) and (a)(2) above, and medicaid shall then seek reimbursement from the third party.N.H.
