Section He-W 508.10 - Denial or Termination of Medical Eligibility for HC-CSDThe department shall deny or terminate medical eligibility for HC-CSD if:
(a) The MRT, in accordance with He-W 508.09(b) , determines that the recipient does not meet the eligibility criteria specified in He-W 508.03 and 508.04; or(b) Both the following occur: (1) A cost reduction plan is not acceptable in accordance with He-W 508.08(b) ; and(2) The recipient fails to submit a request for a fair hearing and for a continuation of benefits during the appeals process to the local district office within 10 calendar days from the date of written notice of adverse decision or termination.N.H.
