Section He-P 807.09 - Inspections(a) For the purpose of determining compliance with RSA 151 and He-P 807, as authorized by RSA 151:6 and RSA 151:6-a, the applicant or licensee shall admit and allow any department representative at any time to inspect the following: (1) The proposed or licensed premises;(2) All programs and services provided by the RTRF; and(3) Any records required by RSA 151 and He-P 807. (b) The department shall conduct a clinical and life safety code inspection, as necessary to determine full compliance with RSA 151 and He-P 807 prior to: (1) The issuance of an initial license;(2) A change in ownership, except as allowed by He-P 807.08(e) (1) ;(3) A change in the licensee's physical location;(4) A change in licensing classification;(5) An increase in the number of clients beyond what was authorized under the initial license;(6) Occupation of space after construction, renovations or structural alterations; or(7) The renewal of a license.(c) In addition to (b) above, the department shall conduct an inspection as necessary to verify the implementation of any POC accepted or issued by the department. (d) A statement of findings for clinical inspections or a notice to correct for life safety code inspections shall be issued when, as a result of any inspection, the department determines that the RTRF is in violation of any of the provisions of He-P 807, RSA 151, or other federal or state requirement.(e) If areas of non-compliance were cited in either a notice to correct or a statement of findings, the licensee shall submit a POC, in accordance with He-P 807.12(c) , within 21 days of the date on the letter that transmits the inspection report.(f) A written notification of denial shall be sent to an applicant applying for an initial license if it has been determined by the inspection mentioned in He-P 807.09(b) that the prospective premises are not in full compliance with RSA 151 and He-P 807.N.H.
