Section He-M 522.18 - Voluntary Withdrawal from Services(a) An individual or guardian may withdraw voluntarily from any service(s) at any time.(b) The administrator of the service from which withdrawal is made shall notify the area agency in writing of the withdrawal and so indicate in the individual's record when such withdrawal was contrary to the individual's service agreement.(c) If service staff or a service coordinator for an individual determine that withdrawal from a service might constitute abuse, neglect, or exploitation on the part of a guardian, the staff or service coordinator shall report such abuse, neglect, or exploitation as required by law.(d) If an individual does not have a guardian and his or her service coordinator or any other person believes that the individual is not able to make an informed decision to withdraw from services and might suffer harm as a result of abuse, neglect, or exploitation, the area agency shall pursue the least restrictive protective means including, as appropriate, guardianship to address the situation.(e) An individual who has withdrawn from services may request resumption of services at any time. Such a request shall be made by the individual or guardian, in writing, to the area agency director.(f) Upon request of the individual or guardian, the area agency director shall resume services to the individual to the extent that funds for this purpose are available and appropriated to the bureau by the Legislature. If there is reason to believe that the individual's eligibility status has changed, the area agency shall request a reapplication pursuant to He-M 522.03.N.H. Admin. Code § He-M 522.18
