Section He-M 403.15 - Hearings(a) A CMHP may request a hearing regarding a denial of approval or reapproval or suspension or revocation of approval.(b) A request for hearing shall be submitted to the commissioner in writing within 20 days following the date of the notification of denial or suspension or revocation.(c) The commissioner or his or her designee shall conduct a hearing in accordance with the procedures set forth in He-C 200 within 30 days of receipt of a request. The presiding officer shall submit a written proposed decision to the commissioner in accordance with RSA 126-A: 5, VIII(d), and He-C 203.22(d) .(d) Within 10 days of the hearing, the commissioner shall issue a proposed decision in accordance with RSA 126-A: 5, VIII(e), and He-C 203.22(e) .(e) The CMHP may appeal the commissioner's decision to a court of competent jurisdiction.N.H.
