Section He-M 1001.12 - Renewal Certification Process
(a) A community residence seeking to renew certification shall apply via the application form obtained from the BHFA entitled "Request for Certification of Community Residence and/or Individual Day Provider" incorporated by reference in He-M 1001.20(a) .
(b) Information entered on the form described in (a) above shall be typewritten or otherwise legibly written.
(c) The community residence shall submit with the application:
(1) A request for renewal of any waiver granted in accordance with He-M 1001.19 that is due to expire within the year following the expiration date of the residence's current certification;
(2) A statement identifying any exception or variance applied for or granted by the state fire marshal in accordance with Saf-C 6005; and
(3) A new, signed approval from the local fire official if renovations were completed since the last submission of a life safety code inspection that:
a. Required a building permit pursuant to local building codes; or
b. Have altered any means of egress.
(d) Community residences applying for renewal certification shall submit the completed application in (a) above 60 days prior to the expiration of the certificate.
(e) The office of program support shall conduct an inspection in accordance with He-M 1001.14(a) prior to recertification of:
(1) A community residence that holds a license pursuant to RSA 151;
(2) A community residence that has increased the number of people receiving residential or day services since its last inspection; and
(3) A community residence that has not been inspected in 2 years as allowed by (h) below.
(f) The renewal period for certificates shall be one year from the expiration date of the previous certificate for:
(1) Community residences certified for 4 or more beds; and
(2) Residences certified for fewer than 3 beds where the certification inspection found 5 or more deficiencies.
(g) A renewal certificate shall be issued for a period of 2 years from the date of the previous certificate when fewer than 5 deficiencies are cited in certified residences with fewer than 4 beds.
(h) Any day service certified in conjunction with the residence shall be includedin the 2 year certification period.
(i) When a renewal certificate is issued for a period of 2 years, the provider agency holding the certification one year following issuance shall conduct a quality assurance visit to ensure the home remains in compliance with all applicable rules.
(j) The written results of this review shall be maintained in the residential record at the home.
(k) When BHFA staff conduct the 2-year inspection:
(1) If the community residence has documentation of a review pursuant to (i) above, BHFA staff shall:
a. Review such documentation; and
b. Cite any deficiency noted during the agency-conducted quality assurance review that has not been addressed; or
(2) If the community residence lacks documentation of a review pursuant to (i) above, BHFA staff shall:
a. Cite this as a deficiency; and
b. Hold the entire 2-year period subject to review.
(l) Notwithstanding (k) (1) above, any documentation maintained by a community residence during its most recent 2-year certification period shall be open to review by BHFA staff for compliance with applicable department rules.
(m) If, at the time an inspection is due, a community residence does not have any individuals living in the residence, it may:
(1) Submit a letter notifying the office of program support of its intent to close; or
(2) Submit a written request to the office of program support for certification renewal without inspection.
(n) The written request shall contain the following:
(1) The name of the community residence provider;
(2) The certificate number;
(3) The location of the community residence; and
(4) The expiration date of the certificate.
(o) A certification requested pursuant to (n) above shall be granted to a community residence holding a valid certificate. The renewal certification shall be valid for 2 years subject to the requirements of and through (q) below.
(p) If a community residence has been approved in accordance with (k) above, the certificate shall indicate: "renewed without inspection."
(q) A provider agency shall notify the office of program support, in writing, within 7 days of an individual moving into the residence.
(r) Pursuant to He-M 1001.14, an on-site inspection shall be conducted, and a plan of correction submitted, if required, within 90 days of receipt of any notification in (n) above.
