Section He-E 807.18 - Investigations of Complaints(a) The survey agency shall investigate all complaints of violations of medicaid participation requirements made by any party in accordance with 42 CFR 488.332 and 42 CFR 488.335.(b) If the survey agency has reason to believe that an identifiable individual has abused or neglected a resident or misappropriated a resident's property, then the survey agency shall conduct an investigation in accordance with 42 CFR 488.335.(c) The survey agency, in conducting an investigation pursuant to 42 CFR 488.335, shall utilize the findings or reports of any other governmental or regulatory agency relative to the incident(s) under investigation, including investigations by the department of health and human services pursuant to RSA 161-F:46 - 57.(d) If the survey agency determines that an individual used by the facility to provide services to residents has abused or neglected a resident or misappropriated a resident's property, the survey agency shall provide notice of the determination in accordance with 42 CFR 488.335(c) .(e) The individual identified by the survey agency as having abused or neglected a resident of a facility, or misappropriated a resident's property may appeal the determination in accordance with He-C 200 and 42 CFR 488.335(d) .(f) If a finding that an individual abused or neglected a resident or misappropriated a resident's property is upheld after an appeal, or if the individual does not appeal the finding, then the finding shall be reported and the report maintained in accordance with 42 CFR 488.335(f) and (g) .N.H.
