Section He-E 807.16 - Relocation Procedures
(a) When the state medicaid agency terminates a NF's provider agreement, or when a facility closes, the state medicaid agency shall arrange for the safe and orderly transfer of the residents to another facility or appropriate placement by:
(1) Identifying the needs of each resident by reviewing available records and consulting with the resident, the facility staff, the resident's family and health care providers;
(2) Informing the long term care ombudsman of the pending relocation;
(3) In consultation with the long term care ombudsman, locating alternative placement for each resident consistent with the resident's needs and, to the extent possible, the preferences of the resident or his/her legal representative as defined in He-E 802.01(t) ; and
(4) Arranging for transportation by ambulance or other appropriate transport from the NF to the alternative placement based on the resident's needs and preferences.
(b) If a NF has been placed in receivership pursuant to RSA 151-F, the relocation of residents and management of the NF shall be subject to the orders of the probate court.
