Section He-E 807.07 - Revisits and Documentation of Substantial Compliance(a) The survey agency shall conduct a revisit to the NF any time between the last correction date listed in the POC and the 60th day from the last date of the survey to determine if compliance has been achieved.(b) If at the time of the revisit, the NF is found by the survey agency to not be in compliance, then the following shall apply:(1) If the seriousness of the non-compliance has worsened, any remedies already in force shall continue and the survey agency shall recommend to the state medicaid agency the imposition of additional remedies; or(2) If the seriousness of the non-compliance has lessened, the survey agency shall recommend to the state medicaid agency any changes to the remedies in (1) above.(c) If a new deficiency is found during a revisit, and the original deficiencies have not been corrected, then: (1) Remedies shall be imposed for the original deficiencies; and(2) The NF may dispute the findings of the new deficiency through the informal dispute resolution process as described in He-E 807.13, except when the new deficiency constitutes immediate jeopardy, in which case the procedures in He-E 807.03(c) and (d) shall apply.(d) If a new deficiency is found during a revisit that results in non-compliance, and the original deficiency has been corrected, then the NF shall be given a notice as described in He-E 807.03 before imposing a remedy.N.H.
