Section He-E 501.07 - Determination, Notice of Eligibility, and Eligibility Period(a) An individual shall meet the requirements in He-E 501.05 and 501.06 in order to be deemed eligible to receive Title XX services. (b) For individuals determined eligible to receive Title XX services, the eligibility period shall be for one year, beginning on the date that eligibility is determined, and ending 364 calendar days later.(c) A written notice of decision shall be provided by the department or by the provider within 45 calendar days of receipt of an application. (d) If the eligibility requirements are met, and services are available, the notice shall include: (1) The services to be provided;(2) The eligibility period; and(3) Contact information for the department or provider, depending on which entity is responsible for the eligibility determination.(e) If eligibility requirements are met, but services are not available, the individual shall be notified that his or her name shall be placed on a wait list in accordance with He-E 501.15.(f) If the eligibility requirements are not met, the notice shall include: (1) The reason(s) for the denial; (2) A statement regarding the right of the individual or his or her authorized representative to request an informal resolution or an administrative hearing, as described in He-E 501.11 501.12 respectively; and(3) Contact information for the department staff member or provider depending on which entity is responsible for the eligibility determination.N.H.
