Section He-C 6443.09 - Participation by the Division in Special Education Placement Teams(a) The division shall attend meetings of the special education placement team and participate in any decisions made at such meetings if: (1) The division receives written notice of the date and time of the team meeting as provided in Ed 1115;(2) The employee of the division assigned to the student's case is available to attend; and(3) The division's attendance is necessary to effectuate the division's case plan for the student.(b) The division shall cooperate with the special education placement team in its development of placement recommendations, including providing the team with access to educational records and those portions of any court-ordered evaluations of the student that are relevant to the team's development of placement recommendations, in the possession of the division upon request by the team, whether or not a representative of the division attends and participates in the meetings of the team.N.H.
