Section He-C 5002.02 - Reconsideration of an Audited Hospital-Specific DSH Limit(a) A hospital may submit a written request to the department for reconsideration of its audited hospital-specific DSH limit pursuant to 42 U.S.C. section 1396r-4(j) (2) if the following criteria are met: (1) The hospital has and submits additional data that has not been previously considered; and(2) There has been no redistribution or recoupment of funds for the fiscal year in question for that hospital or any other hospital.(b) For the fiscal year 2013 audit, which was issued December 31, 2016, hospitals shall have 13 months from the date of issuance to request reconsideration.(c) For audit reports for fiscal year 2014 and later, hospitals may request reconsideration within 3 months of issuance of the audit report.(d) If, in the auditor's opinion, the additional data would have a material impact on the amount paid to the hospital for that year, the auditor shall conduct a reassessment and issue an addendum, which the auditor shall send to the department.N.H.
