Section Hcp 402.05 - Disciplinary Continuing Education
(a) "Disciplinary continuing education" means any course or seminar that an apprentice or audiologist or hearing aid dealer is ordered, by the board, to take for the purpose of addressing a finding of misconduct based upon deficient skills, and which is in addition to the continuing education requirements set forth in Hcp 403.
(b) The sanction of disciplinary continuing education shall be imposed only after notice and opportunity for a hearing in those cases in which the board determines that the apprentice or audiologist or hearing aid dealer's misconduct arose, at least in part, through deficient skills necessary for some aspect of his or her practice.
(c) The failure by an audiologist or hearing aid dealer to take the disciplinary continuing education ordered by the board shall be grounds for further discipline by the board and a basis for judicial action seeking to collect the penalty.
