Section Hab 203.01 - Petitions or Board Initiated Rule Changes
(a) This section shall apply to rule changes initiated by the board or by any person petitioning the board to adopt, amend or repeal the board's rules. Any person may request the board to commence a proceeding for the purpose of adopting, amending, or repealing a rule by filing a written petition that contains:
(1) A statement of the petitioner's request for the proposed rule;
(2) The text of the proposed rule or a statement of the particular results intended by the petitioner's interest in the subject matter of the proposed rule;
(3) An identification of the particular rule sought to be amended or repealed;
(4) Any argument the petitioner believes would be useful to the board in deciding whether to commence a rulemaking proceeding; and
(5) Name, mailing address, signature of petitioner and date.
(b) A petition to adopt, amend or repeal a rule shall be submitted to the board's clerk. The clerk shall schedule a board meeting in compliance with RSA 91-A and present the petition to the board.
(c) The board shall:
(1) Notice the petitioner of the meeting at which the petition will be reviewed;
(2) Consider the petition; and
(3) Request further information, if necessary.
(d) Within 30 days of receipt of a request or amended request for rulemaking, the board shall take one of the following actions:
(1) Initiate the requested rulemaking procedures, in accordance with this part; or
(2) Deny the request if it is contrary to the purpose of the underlying statute and respond, in writing, stating the reasons for denial.
(e) A petition to adopt, amend, or repeal a rule shall:
(1) Be limited to a single subject; and
(2) If the petition concerns a rule, cite the rule in question.
