Section Eth 212.08 - Closing the Record(a) After the conclusion of the hearing, the record shall be closed and no other evidence shall be received into the record, except as allowed by (b) below and Eth 212.09.(b) Before the conclusion of the hearing, a party may request that the record be left open to allow the filing of specified evidence not available at the hearing. If the presiding officer determines that such evidence is necessary to a full consideration of the issues raised at the hearing, the presiding officer shall keep the record open for the period of time necessary for the party to file the evidence.(c) Unless waived by the other party or parties, the party filing the evidence shall, to the extent required by due process, make the proponent of such evidence available for cross-examination.N.H.
