Section Env-WtC 202.05 - Presiding Officer(a) The presiding officer for general proceedings shall be the chairperson of the council if present and willing to preside. If the chairperson is unavailable for any reason, the presiding officer shall be the vice-chair, if available, or a member of the council selected by those members present at the meeting.(b) The presiding officer at a prehearing conference or for an appeal hearing shall be the chairperson of the council or the council member who is designated to preside by the chairperson.(c) The presiding officer for general proceedings shall regulate the course of the proceedings and take such other action that is necessary for the efficient and orderly conduct of the proceedings, consistent with these rules and any other applicable state law.(d) Unless otherwise provided, the presiding officer at an appeal hearing or prehearing conference shall: (1) Regulate the course of the conference or hearing;(2) Rule on issues of evidence;(3) Rule upon issues of procedure;(4) Administer oaths or affirmations; and(5) Take such other action as necessary for the efficient and orderly conduct of the hearing, consistent with these rules and any other applicable law.(e) Exceptions to rulings of the presiding officer in an appeal shall be considered to have been preserved if a contemporaneous oral or written objection is: (1) Made on the record of the appeal; and(2) Included in a petition for reconsideration.N.H.
