Section Env-Wt 803.11 - Notification of Decision on a Proposed In-Lieu Mitigation Payment(a) For applicants proposing an in-lieu mitigation payment, the department shall issue a notice to the applicant and the municipality that shall include: (1) A calculation of the amount the applicant must pay prior to issuance of a permit as specified in Env-Wt 807.01; and(2) A statement that if the in-lieu mitigation payment is not paid as specified in Env-Wt 807.01, the department shall deny the permit.(b) If an applicant, who has been notified that a revised mitigation proposal is required, does not submit a revised mitigation proposal by the deadline specified in the notice or such longer time period as agreed to by the applicant and the department in accordance with RSA 482-A, the department shall deny the application.N.H.
