Section Env-Or 605.05 - Emergency and Initial Response Action Approval(a) The responsible party shall submit a work scope describing a proposed emergency or initial response action to the department for approval prior to implementation except as provided for in (c), below.(b) The department shall approve a work scope for an emergency or initial response action if it is consistent with the applicable provisions of Env-Or 605.03 and Env-Or 605.04.(c) In order to minimize contamination, reduce risk of exposure, or promote more timely response actions, the responsible party may begin emergency or initial response actions at a site before the work scope is submitted to or approved by the department, provided the responsible party: (1) Notifies the department either verbally or in writing of the proposed activities to be conducted prior to beginning the response actions;(2) Incorporates the self-initiated measures into the report submitted to the department pursuant to Env-Or 605.06 below; and(3) Complies with the requirements of all other applicable local, state, and federal rules and statutes.N.H.
