Section Env-Dw 709.23 - Bacteria Violations(a) An E. coli MCL violation shall exist if: (1) Any routine sample tests positive for total coliforms and is followed by any repeat sample that tests positive for E. coli;(2) Any routine sample tests positive for E. coli and any of the repeat samples test positive for total coliforms;(3) The owner fails to collect all required repeat samples following an E. coli-positive routine sample; or(4) The owner fails to test for E. coli when any repeat sample tests positive for total coliforms.(b) A treatment technique violation shall exist when a system exceeds a trigger specified in Env-Dw 709.22 and the owner fails to conduct the required assessment or corrective action within the time specified in Env-Dw 720.(c) A monitoring violation shall exist if the owner: (1) Fails to collect every required routine or additional routine sample in a compliance period; or(2) Fails to analyze for E. coli following a routine total coliform-positive result.(d) A reporting violation shall exist if the owner:(1) Fails to submit a monitoring report or completed assessment form after the system properly conducts monitoring or assessment within the time period specified; or(2) Fails to notify the department of an E. coli-positive sample required by Env-Dw 719 within the time period specified.N.H.
