Section Env-A 1504.02 - Applicability(a) Pursuant to §176(c)(1) of the Act, this part shall apply to any federal department, agency, or instrumentality that meets the applicability criteria as specified in 40 CFR § 93.153.(b) This part shall not apply to any entity subject to a conformity determination for a federal action related to a transportation plan, program, or project developed, funded, or approved under 23 USC §§ 101et seq. or the Federal Transit Act, as amended, 49 USC §§ 1601et seq.N.H.
