Section Env-A 1412.04 - Decision to Grant or Deny the Petition(a) The commissioner shall act on the petition within the time limits specified in RSA 541-A:4.(b) As specified in RSA 125-:4, V(a)I, the commissioner shall not add a substance or compound to the RTAP list unless there is at least one study that has been conducted in accordance with generally accepted scientific principles that demonstrates that the substance or compound is known to cause or may reasonably be anticipated to cause acute, chronic, mutagenic, reproductive, or developmental health effects in humans as a result of exposure to such substances or compounds.(c) As specified in RSA 125-:4, V(b)I, the commissioner shall not delete a substance or compound from the RTAP list unless there is at least one study that has been conducted in accordance with generally accepted scientific principles that demonstrates that the substance or compound cannot reasonably be anticipated to cause acute, chronic, mutagenic, reproductive, or developmental health effects in humans as a result of exposure to such substances or compounds.(d) In addition to the criteria specified in (b) or (c), above, as applicable, the commissioner shall not grant a petition unless doing so will result in standards that promote human health.N.H.
