Section Env-A 1407.02 - Criteria for Classification of Class I Regulated Toxic Air Pollutants The department shall classify an RTAP as a class I RTAP if it meets at least one of the following criteria:
(a) Pursuant to RSA 125-:2, XV(a)I, it is a group A, group B1, or group B2 carcinogen, as described in "Guidelines for Carcinogen Risk Assessment," 51 Federal Register 33,992, at 34,000 (Sept. 24, 1986);(b) It is categorized as "Carcinogenic to Humans" or "Likely to be Carcinogenic to Humans" as described in EPA's updated "Guidelines for Carcinogenic Risk Assessment," 70 Federal Register 17765 to 17817 (April 7, 2005);(c) It is a category A1 or A2 carcinogen, as described in Threshold Limit Values for Chemical Substances and Physical Agents and Biological Exposure Indices, published by the American Conference of Governmental Industrial Hygienists (ACGIH);(d) It has been demonstrated through at least one study conducted in accordance with generally accepted scientific principles that it is capable of inducing reproductive or developmental effects in experimental laboratory animals at doses less than or equal to 500 mg/kg; or(e) It has an acute toxicity where the: (1) Oral LD is less than or equal to 50 milligrams per kilogram of body weight (mg/kg);(2) Inhalation LC is less than or equal to 200 parts per million (ppm); or(3) Dermal LD is less than or equal to 200 mg/kg.N.H.
