Section Env-A 103.04 - Designated representative"Designated representative" means any of the following:
(a) "Responsible official" as defined in Env-A 104;(b) "Designated representative" as defined in section 402(26) of the Act, namely "a responsible person or official authorized by the owner or operator of a unit to represent the owner or operator in matters pertaining to the holding, transfer, or disposition of allowances allocated to a unit, and the submission of and compliance with permits, permit applications, and compliance plans for the unit"; or(c) In matters pertaining to the requirements of title IV Acid Deposition Control, a person who is authorized by the owner or operator of an acid rain affected source, or all acid rain affected units at such an affected source, as those terms are defined by federal law, as evidenced by a certificate of representation, to represent or legally bind the owner or operator in matters of federal law, including but not limited to the following: (1) The holding, transfer, or disposition of allowances allocated to an acid rain affected unit; and(2) The submission of, or compliance with, permits, permit applications, compliance plans, emission monitoring plans, continuous emissions monitor (CEM) and continuous opacity monitor (COM) certification notifications, CEM and COM certification and applications, quarterly monitoring and emission reports, and annual compliance certifications.N.H.
