Section Ed 1126.02 - Criteria for Approval of Public and Non-Public Programs(a) The department shall use the requirements in Ed 1126 as the basis for determining program approval.(b) The department shall approve public and non-public programs for children with disabilities through a monitoring process, including but not limited to on-site visit(s) and examination of written documentation, by reviewing the following: (1) Administrative staff, including certification and professional development;(2) Instructional staff, including certification and professional development;(3) Policies and procedures, including: a. Procedures for handling confidential information;b. Due process guarantees;c. Least restrictive environment processes;d. Child find activities;e. Non-discriminatory testing practices; and(4) School program operation;(5) School program information;(7) Fiscal aspects of the school, class, or program;(9) Monitoring of IDEA and Title I of the Elementary and Secondary Education Act;(10) Compliance with state statutes and state board of education rules;(11) Compliance with federal statutes and regulations;(12) For LEAs, a review of the LEA request for special education funds;(13) Review of complaint procedures;(14) For LEAs, a review of placement practices;(15) Review of data systems;(16) Examination of least restrictive environment practices; and(17) Any other component mentioned elsewhere in Ed 1100.N.H.
