Section Ed 1115.09 - Surrogate Parents for Children Placed in Homes for Children, Health Care Facilities, or State Institutions(a) Notwithstanding the requirements of Ed 1115, Ed 1115.09(b) shall apply for children in placements pursuant to RSA 169-B, RSA 169-C or RSA 169-D.(b) Upon a DCYF or DYDS referral meeting the requirements of Ed 1115.02, the commissioner shall appoint a surrogate parent in accordance with Ed 1115.05 except as noted below: (1) The process for appointment of a surrogate parent shall not exceed 45 days from the date on which the department receives the request for appointment;(2) If a parent objects to the appointment of a surrogate parent, the decision whether or not to appoint a surrogate parent shall be made within 55 days of the date on which the superintendent of schools or department received the referral; and(3) In all instances where information from the liable LEA is necessary to make a determination whether a surrogate parent should be appointed, it shall be the responsibility of the liable LEA to provide, in a timely manner, all the information necessary to complete the process of determining whether a surrogate parent should be appointed.N.H.
