A licensee who is the subject of a complaint, investigation, or hearing regarding allegations of misconduct may, as part of a settlement resolving the issues of the complaint or investigation, voluntarily surrender the license by delivering it to the board and stating in writing that:
(a) The surrender is freely rendered;(b) The licensee is not being subjected to coercion or duress;(c) The licensee is fully aware of the implications of surrendering the license;(d) The licensee is aware that there is presently pending a complaint or an investigation, the nature of which the licensee shall specifically set forth; and(e) The licensee acknowledges that the material facts upon which the complaint is predicated are true.N.H.
